You should look at a law firm closely. See what type of cases the firm actually handles and if they are actually trial attorneys who will be able to fully prosecute your case. Some firms refer out cases if they will be litigated or just try to settle cases in order to avoid trial. Although a large number of cases do settle, insurance companies and their lawyers know which firms are willing to litigate a case in front of a jury and which firms ultimately settle every case they have. You can be assured that the amounts that insurance companies offer to injured plaintiffs is influenced by this knowledge. If the insurance company is confident that a case will never see a jury (and that there is little risk to the insurance company), the company is not going to offer full value to settle a personal injury case. When you are looking into a firm to hire, you should ask the person you are speaking with if they are trial attorneys and have experience and expertise in trying cases.
Marketing Ploys
It is becoming more and more frequent to see flashy ads in the subway, bus benches, billboards, and other public places – all advertising that they are the “best” personal injury law firm. It is even common to see commercials on TV boasting of high verdicts and settlements with little to no context. These advertisements just emphasize large amounts of money with no information on the types of cases, the attorney that handled it, or whether the results were truly favorable for the client. You should do further research into the firm and its attorneys to get a better understanding of their experience in the Massachusetts court system, and their reputation.
