The jury award is the largest wrongful death/personal injury verdict in Massachusetts in 2011 and was upheld on appeal. Aleo v. SLB, 466 Mass. 398 (2013).
A four-year old boy fell to his death through a gap between an escalator and the adjacent railing. The escalator had been installed as a replacement and was narrower than the original escalator. The escalator construction company failed to install deck barriers as required by the construction plans and by state escalator and building codes, resulting in the escalator being in a defective and dangerous condition. After extensive discovery, SUGARMAN lawyers settled the wrongful death lawsuit with the escalator contractor, store, and mall owner for the benefit of the boy’s parents.

Post-operative stage diagnostic studies revealed that the graft was displaced and deforming her iliac vein and arteries. Settlement in product liability lawsuit for a Boston airline worker who sustained fractures of his pelvis and hip when the safety rails on a cargo loader failed to activate, allowing a 1,500 lb. pallet to move off the loader and land on the worker after the pallet fell approximately 15 feet. The accident occurred due to a manufacturing defect in an electronic sensor used to activate the safety rails whenever the loader was in operation.
Settlement in product liability suit for construction worker who sustained severe crush and cardiovascular injuries due to the defective design of a safety device in an elevating scissor lift that allowed the lift to rise due to inadvertent contact with the joystick – the very hazard the safety device was intended to prevent.
Settlement of wrongful death case on behalf of a family who lost a child as a result of carbon monoxide poisoning. SUGARMAN attorneys brought product liability and general negligence claims alleging improper installation of a residential boiler, and a defect in the boiler which allowed it to create and introduce high concentrations of carbon monoxide into the home during foreseeable weather events, such as heavy snow storms.
Settlement of wrongful death lawsuit reached for the four young children of a construction worker who was killed when a massive steel craneway in Quincy collapsed. The general contractor failed to develop an engineering or demolition plan for the dismantling of the craneway and made cuts that left a portion of it a free-standing structure without securing it or warning any of the workers at the site of the danger posed by the free-standing structure.
